Terms of Service

The service

OneTouchReview lets a business send its customers review requests by text and email, collect private feedback, see its Google and Facebook reviews, and reply to them. Features depend on the plan. We may change or improve features over time.

Your account

Keep your sign-in details safe and tell us if you think someone else is using your account. You are responsible for what happens in your account, including what the people you add to it do. Give us true details about your business.

Your duties when you contact customers

• Consent: only text customers who agreed to get texts from your business, and keep a record of that consent. Only email people you have a business relationship with.
• Opt-outs: we stop texts to anyone who replies STOP, and email to anyone who unsubscribes. Do not try to get around this.
• The law: follow the laws that apply to your messages, including the TCPA, CAN-SPAM and state laws, and the carriers' rules for business texting.
• Ask every customer the same way: do not ask only happy customers for public reviews.
• No incentives: never offer money, discounts, gifts or anything else for a review.
• Review site rules: follow the rules of Google, Facebook, Yelp and any other site you send customers to. Never ask anyone for Yelp reviews; Yelp does not allow it.
• No fake reviews: do not write reviews of your own business, or ask anyone to write false ones.
• Privacy in replies: do not share customers' personal, health or case details in replies to reviews.

You are responsible for the messages you send and the replies you post through OneTouchReview, including ones you post from a suggested reply.

Acceptable use

Do not use OneTouchReview to:

• send spam, or messages that are misleading, harassing, hateful or illegal;
• upload contacts you have no right to use;
• break into, overload, scrape or reverse-engineer the service;
• resell the service or let others use your account without our OK;
• break anyone else's rights or any law.

We may pause messages or an account that breaks these rules, or that a carrier or review site flags.

Plans and billing

Plans and prices are on the pricing page. Billing is not turned on yet. Before we charge for a plan, we will tell you the price and ask you to agree. Once billing starts, paid plans renew until cancelled, and you can cancel any time; the plan stays active to the end of the paid period. We will give notice before a price change applies to you.

Third-party platforms

OneTouchReview works with Google, Facebook, Twilio, email providers and other services we do not control. Their terms apply when you connect or use them. They can change or stop their services, and that can affect features in OneTouchReview. We cannot remove, edit or guarantee any review on another site, and we are not responsible for what those sites do.

Your data

Your business data stays yours. You let us use it only to run the service for you, as our Privacy Policy explains. You can delete it at any time; see Data Deletion.

Disclaimers

We work to keep OneTouchReview reliable, but the service is provided "as is" and "as available". We do not promise it will be uninterrupted or error-free, that messages will always be delivered, or that you will get a certain number of reviews or a certain rating. Suggested replies are drafts; check them before you post.

Limitation of liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or harm to reputation. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or US$100 if that is more. Some places do not allow these limits, so they may not all apply to you.

You agree to cover our losses from claims caused by the messages you send, the replies you post, or your breaking of these terms.

Ending the agreement

You can stop using OneTouchReview and delete your account at any time in Settings. We may suspend or close an account that breaks these terms, puts others at risk, or does not pay once billing starts; where we can, we will tell you first. When an account is closed, we delete its data as our Privacy Policy says.

Governing law

The law that governs these terms and the courts for disputes will be named here. Until then, if you have a dispute, please email us first and we will try to solve it.

Changes

We may update these terms. We will change the date at the top and, for significant changes, tell account owners by email or in the app before they take effect. If you keep using the service after that, the new terms apply.
